D2L Brightspace Community Bingo Contest Terms and Conditions

THIS CONTEST IS OPEN ONLY TO RESIDENTS OF CANADA (EXCLUDING RESIDENTS OF QUEBEC) AND THE 50 UNITED STATES (INCLUDING THE DISTRICT OF COLUMBIA). CONTEST IS GOVERNED BY THE LAWS OF ONTARIO. 

NO PURCHASE NECESSARY. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING. 

1. CONTEST PERIOD: 

The D2L Brightspace Community Bingo Contest (the “Contest”) begins on May 31, 2023, at 9 a.m. Eastern Time (“ET”) and ends on June 14, 2023, at 5:00 p.m. ET (the “Contest Period”). 

2. ELIGIBILITY: 

Contest is open to all legal residents of Canada (excluding residents of Quebec) and the United States, who have reached the age of majority in their province/territory/state of residence at the time of entry, except employees, representatives or agents (and those with whom such persons are domiciled, whether related or not) of D2L Corporation (the “Sponsor”), its affiliated companies, prize suppliers and advertising/promotion agencies (collectively, the “Contest Parties”). Void where prohibited. 

3. HOW TO ENTER: 

The information you provide will only be used for the administration of this Contest and in accordance with the Sponsor’s privacy policy (see below). D2L is completely released from all liability by each entrant in this Contest. Any questions, comments or complaints regarding the Contest must be directed to the Sponsor. You may only submit one entry (the “Submission”) to participate in this Contest. 

NO PURCHASE NECESSARY. To participate in the Contest, complete a full row of five (5) Community Bingo activities and submit the form at D2L.com/community-bingo. By entering your Submission, you signify your agreement that you have read and agree to be legally bound by the terms and conditions of these Official Rules and Regulations (the “Rules”). To be eligible, your Submission must be received within the Contest Period. An eligible Submission will automatically result in one (1) entry (the “Entry”) into the random prize draw (see Rule 5). 

There is a limit of one (1) Entry per person permitted during the Contest Period. If it is discovered that any person has attempted to: (i) obtain more than one (1) Entry per person during the Contest Period; and/or (ii) use (or attempt to use) multiple names and/or identities; then (in the sole and absolute discretion of the Sponsor) he/she may be disqualified from the Contest and all of his/her Entries voided. Your Entry will be rejected if (in the sole and absolute discretion of the Sponsor) the instructions are not followed and are not submitted and received during the Contest Period. Use (or attempted use) of multiple names, identities, and/or any automated, macro, script, robotic or other system(s) or program(s) to enter or otherwise participate in or disrupt this Contest is prohibited and is grounds for disqualification by the Sponsor. The Releasees (defined below) are not responsible for late, lost, misdirected, delayed, incomplete or incompatible Entries (all of which are void). 

All Entries are subject to verification at any time. The Sponsor reserves the right, in its sole and absolute discretion, to require proof of identity and/or eligibility (in a form acceptable to the Sponsor – including, without limitation, government issued photo identification) to participate in this Contest. Failure to provide such proof to the satisfaction of the Sponsor in a timely manner may result in disqualification. The sole determinant of the time for the purposes of a valid Entry in this Contest will be the Contest server machine(s). 

4. THE PRIZE AND APPROXIMATE RETAIL VALUE: 

There will be 81 prizes available to be won: 

  • There is one (1) grand prize that consists of two (2) passes for the Fusion 2023 or Fusion 2024 conference (the “Grand Prize”).  
  • There are 80 prizes each consisting of a $50 USD voucher that can be used for D2L swag of the winner’s choice at brightspaceshop.com (subject to availability), or donation to a designated charity (the “Prize”). 

The Grand Prize and Prizes must be accepted as awarded and is not transferable, assignable, or convertible to cash (except as may be specifically permitted by Sponsor in its sole and absolute discretion). No substitutions except at Sponsor’s option. Sponsor reserves the right, in its sole and absolute discretion, to substitute the Grand Prize or Prize or a component thereof with a prize of equal or greater value, including, without limitation, but at Sponsor’s sole and absolute discretion, a cash award. The Grand Prize and Prizes will only be awarded to the person whose verifiable full name and valid email address appears on the Submission form. All federal, state, provincial and local taxes and any other costs and expenses associated with the acceptance and/or use of the Grand Prize or Prize not specifically provided for in these Rules are solely the winner’s responsibility. Winner is solely responsible for reporting and paying any and all applicable taxes and additional fees associated with acceptance and use of the Grand Prize or Prize. Winner must provide the Sponsor with valid identification before any Prize will be awarded. 

5. RANDOM PRIZE DRAW AND WINNER SELECTION: 

The random prize draw will take place on June 15, 2023, at approximately 12:00 p.m. (the “Draw Date”) in Ontario. The odds of winning depend on the number of eligible Entries received during the Contest Period. 

The Sponsor or its designated representative will make a minimum of one attempt to contact the selected entrants by email within three (3) business days of the Draw Date.  

  • The entrant selected for the Grand Prize will receive information via email.  
  • The entrants selected for the Prize will receive a voucher code via email to be used at brightspaceshop.com. The voucher code will be valid for seven (7) days.  

If the selected entrant cannot be contacted, or if there is a return of any notification as undeliverable, or if the entrant does not claim the prize within 7 days of being notified; then he/she will be disqualified (and will forfeit all rights to the prize) and the Sponsor reserves the right, in its sole and absolute discretion, to randomly select an alternate eligible entrant from among the remaining eligible Entries (in which case the foregoing provisions of this section shall apply to such new selected entrant). 

BEFORE BEING DECLARED THE CONFIRMED PRIZE WINNER, the selected entrant will be required to: (a) Only Required for Canadian residents: correctly answer a mathematical skill testing question without mechanical or other aid; and (b) sign the Sponsor’s declaration and release form, which (among other things): (i) confirms compliance with these Rules; (ii) acknowledges acceptance of the prize as awarded; (iii) releases the Contest Parties and each of their respective officers, directors, agents, representatives, successors and assigns (collectively, the “Releasees”) from any and all liability in connection with this Contest, his/her participation therein and/or the awarding and use/misuse of the prize or any portion thereof; and (iv) agrees to the publication, reproduction and/or other use of his/her name, , voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor in any manner whatsoever, including print, broadcast or the internet. If the selected entrant: (a) fails to correctly answer the skill testing question (only for Canadian residents); (b) fails to return the properly executed Contest documents within the specified time; and/or (c) cannot accept the prize as awarded for any reason; then he/she will be disqualified (and will forfeit all rights to the prize) and the Sponsor reserves the right, in its sole and absolute discretion, to randomly select an alternate eligible entrant from among the remaining eligible Entries (in which case the foregoing provisions of this section shall apply to such new selected entrant). 

6. GENERAL CONDITIONS: 

All Entries become the property of the Sponsor. This Contest is subject to all applicable federal, state, provincial and municipal laws. The decisions of the Sponsor with respect to all aspects of this Contest are final and binding on all entrants without right of appeal, including, without limitation, any decisions regarding the eligibility/disqualification of Entries and/or entrants. By participating in this Contest, you are agreeing to be legally bound by the terms and conditions of these Rules. 

The Releasees will not be liable for: (i) any technical malfunction or other problems relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; (ii) the failure of any Entry to be received for any reason, including, but not limited to, technical problems or traffic congestion on the Internet or at any website; (iii) any injury or damage to an entrant’s or any other person’s computer or other device related to or resulting from participating in the Contest; and/or (iv) any combination of the above. 

The Sponsor reserves the right, in its sole and absolute discretion, to withdraw, amend or suspend this Contest (or to amend these Rules) in any way, in the event of an error, technical problem, computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure or any other cause beyond the reasonable control of the Sponsor that interferes with the proper conduct of this Contest as contemplated by these Rules. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest in any way (as determined by Sponsor in its sole and absolute discretion) is a violation of criminal and civil laws and should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law. The Sponsor reserves the right, in its sole and absolute discretion, to cancel, amend or suspend this Contest, or to amend these Rules, without prior notice or obligation, in the event of any accident, printing, administrative, or other error of any kind, or for any other reason. 

By entering this Contest, each entrant expressly consents to the Sponsor, its agents and/or representatives, storing, sharing and using the personal information submitted with his/her Entry only for the purpose of administering the Contest and in accordance with Sponsor’s privacy policy (available at: d2l.com/legal/privacy), unless the entrant otherwise agrees. 

The Sponsor reserves the right, in its sole and absolute discretion, and without prior notice, to adjust any of the dates and/or timeframes stipulated in these Rules, to the extent necessary, for purposes of verifying compliance by any entrant or Entry with these Rules, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Rules, or for any other reason. 

In the event of any discrepancy or inconsistency between the terms and conditions of these Rules and disclosures or other statements contained in any Contest-related materials, including, but not limited to: the website and/or point of sale, television, print or online advertising; the terms and conditions of these Rules shall prevail, govern and control. 

Winners List: To receive a list of winner(s), send a stamped self-addressed envelope to: “D2L Brightspace Community Bingo Contest” Winner List c/o Legal Department, 137 Glasgow Street, Suite 560, Kitchener, Ontario, N2G 4X8. Request for winner’s list must be received between June 14, 2023, and June 23, 2023.
